Terms of Service
These Terms of Service ("Terms") govern access to and use of the Fnolwise platform, APIs, and website (collectively, the "Services") operated by Fnolwise, Inc. ("Fnolwise," "we," or "us"). By accessing or using our Services, you agree to be bound by these Terms.
If you are accessing the Services on behalf of an insurance carrier or other organization ("Carrier Client"), you represent that you have authority to bind that organization to these Terms. These Terms apply to all users, including Carrier Client personnel accessing the platform under an enterprise subscription agreement.
1. Access and Accounts
1.1 Authorized Use
Access to the Fnolwise platform is granted solely to authorized Carrier Clients under a separate subscription agreement. Website access and demo requests are available to prospective clients and industry professionals.
1.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials. Given the sensitive nature of commercial insurance FNOL data accessible through the platform, you must:
- Use strong, unique passwords for your Fnolwise account
- Enable multi-factor authentication when required by your Carrier Client configuration
- Notify Fnolwise immediately of any unauthorized access or suspected credential compromise
- Not share account credentials with other individuals
2. Platform Use Restrictions
You agree not to:
- Use the Services to process claims data outside the scope of your Carrier Client agreement
- Attempt to access, extract, or copy FNOL data belonging to another Carrier Client
- Reverse engineer, decompile, or attempt to derive source code from the platform
- Use the Services for any unlawful purpose or in violation of applicable insurance regulations
- Submit false, fraudulent, or fabricated FNOL data through the platform
- Interfere with platform operation or attempt unauthorized access to platform infrastructure
- Use automated tools to scrape, crawl, or bulk-extract data from the platform outside of authorized API access
3. Sensitive Data Obligations
The Fnolwise platform processes sensitive commercial insurance data including FNOL records, policy information, and claimant data. As a platform user, you acknowledge:
- Access to FNOL data through the platform is limited to individuals with a legitimate need in connection with commercial claims operations
- FNOL data accessed through the platform may not be used for any purpose outside adjuster assignment and claims handling
- Fnolwise's processing of FNOL data is governed by the Data Processing Agreement between Fnolwise and your Carrier Client
- You are subject to applicable state and federal insurance data privacy regulations governing the data you access
4. Intellectual Property
The Fnolwise platform, including its triage algorithms, severity classification models, intake normalization logic, and software, is proprietary to Fnolwise, Inc. and protected by applicable intellectual property laws. Nothing in these Terms grants you ownership rights in the platform or its underlying technology.
FNOL data submitted through the platform by a Carrier Client remains the property of that Carrier Client. Fnolwise asserts no ownership rights over claim data.
5. Service Availability and SLAs
Fnolwise maintains commercially reasonable infrastructure to support platform availability. Specific uptime SLAs, maintenance windows, and incident response commitments are set forth in each Carrier Client's subscription agreement. This website and public-facing content are provided as-is without uptime guarantees.
6. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. FNOLWISE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FNOLWISE DOES NOT WARRANT THAT SEVERITY TRIAGE CLASSIFICATIONS OR ADJUSTER ASSIGNMENT RECOMMENDATIONS WILL BE CORRECT IN ALL CASES OR SUITABLE AS THE SOLE BASIS FOR CLAIMS DECISIONS.
Triage classification outputs are recommendations intended to support — not replace — the judgment of licensed claims professionals.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FNOLWISE'S AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNTS PAID BY THE APPLICABLE CARRIER CLIENT TO FNOLWISE IN THE TWELVE MONTHS PRECEDING THE CLAIM. FNOLWISE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
8. Governing Law
These Terms are governed by the laws of the State of Connecticut, without regard to conflict of law principles. Disputes arising under these Terms shall be resolved in the state or federal courts located in Hartford County, Connecticut.
9. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated to Carrier Clients at least 30 days before they take effect. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
